H1B Quota Full Till October 2012

11/24/11. Summary:

Today USCIS announced that the H1B quota of 65,000 has been filled.  New H1B petitions will be accepted on April 1, 2012 for employment beginning no earlier than October 1, 2012.

Some employers and some employees are not subject to the H1B quota and may continue filing H1B petitions without limitation. In addition, there are alternative visas which provide work authorization and are now available including, among others,:

Immigration for Entrepreneurs Broadened

08/02/11. Summary:

Today USCIS announced that it is broadening the interpretation of the National Interest Waiver (NIW) immigration category to include entrepreneurs and business people investing in the U.S. and creating jobs in the U.S.

The National Interest Waiver immigration category is not new.  We have been successfully preparing Immigrant Petitions under the National Interest Waiver (NIW) category for over 10 years.  Our NIW clients are usually post doctoral researchers conducting cancer research, plant biology research to increase farmers' yields, nuclear energy, and other researchers in science or medicine.  In the past, USCIS has been reluctant to consider our national interest in investment and job creation.

F-1 OPT Work Authorization Extension

06/17/11. Summary:

Under "Cap Gap" rules, once a timely H-1B Petition has been filed requesting a change of status to H-1B on October 1, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension will continue through September 30 unless the petition is denied, withdrawn, or revoked.
