Approved Labor Certifications May Expire By January 12, 2008
In May we reported on a new U.S. Department of Labor rule which results in approved Labor Certifications expiring after 180-days if not filed in support of an employee's Immigrant Petition (I-140).
Under this relatively new rule, Labor Certifications approved on or before July 16, 2007 will expire on January 12, 2008, unless it is filed prior to that date in support of an employee's Immigrant Petition (I-140).
Labor Certifications approved after July 16, 2007 will expire 180 days after the Labor Certification Application is approved (certified), unless it is filed prior to the 180th day in support of an employee's Immigrant Petition.
HR should carefully track and calendar Labor Certifications to avoid expiration of Labor Certifications within 180-days from approval.
