Employment Based Immigration Information
Immigration is possible through employment, close family, asylum and diversity lottery, among many other categories. Our practice focuses on immigration through employment, although we frequently file family based immigration cases, as well.Generally, employment-based immigration requires that a U.S. company sponsor the immigrant and, through a process called Labor Certification, show that there is a shortage of U.S. workers. Labor Certifications are currently administered by the U.S. Department of Labor through its on-line PERM process.
Some immigration cases do not require Labor Certification, such as First Preference Immigration Petitions under the Extraordinary Ability , Multi-National Executive or Manager , and Outstanding Researcher or Professor categories, and National Interest Waiver Immigrant Petitions. Other cases require Labor Certification, but do not require a showing that there is a shortage of U.S. workers, such as Special Handling Labor Certification for tenure-track college and university professors.
