Premium Processing Available for Some Immigrant Petitions
Starting June 16, 2008, USCIS will begin accepting Premium Processing requests for Employment-based Immigrant Petitions (form I-140). The requirements are that the worker must be: 1) in H-1B status; 2) reaching the end of his or her 6 year limit within 60 days; and 3) ineligible to extend his or her H-1B status under AC21, generally because their immigration case has been pending for less than one year.
